hmmm...

Lexus being serviced, loaner from dealer gets accelerator stuck and brakes fail and car will not turn off. There will be a huge lawsuit. Too bad the kid was in the car too.

They couldn't 1) put the car in P or R or L; 2) turn off the ignition (key)?

Yep. Lawsuit.

Did anyone survive?

Nope.
Apparently its a flaw with push button start, as read in comments.

IC. Didn't see any comments...just the audio file.

The Aussie brings up another point: emergency brake.

Handbreak wouldn't do much at that speed, especially with the car still in gear and the engine going flatout.  Might lower the overall top speed it reaches, but won't stop it.

In that situation I think you're supposed to put the car in Neutral, then brake.

There isn't a manual override on the shifter?

All the automatic transmission cars I've driven have a little cover next to the shifter that acts as a manual release for the shifter locking mechanism, so you can slide it to N or P.

turning the car before it got to such a high speed and risking flipping would probably have been a better option than slamming into that ditch

Not sure the road they were driving on, but even brushing against the concrete barriers would be preferable, maybe small brush?
I'd rather not intentionally flip a car if i could avoid it.

Handbrake would have done nothing, he obviously burned out the main brakes.
If you can't kill then engine or put it in neutral you're pretty stuffed, not sure if thats the case - depends on the gearbox.

Until you've been in a situation like that its hard to criticise the guy for not doing something which might have seemed obvious, like putting it in neutral.

OTOH It always amazes me how many people jump in a car without familiarising themselves with how it works, even the basics, like how to switch it off.

Dealer was probably negligent in not explaining how the thing worked, and providing a vehicle where the pedal jammed.

You can't say what you would've done because you weren't in that situation

that's like saying "if a car was driving towards me I would've jumped out of the way" chances are you'd freeze up and get flattened

Dilbert, the floor mat might have slid forward by total accident. Things happen by accident you know. There isn't always someone at fault. Geeze, I wish you would leave this forum.
I wish people would read OPs before they start spouting.
The loaner from Bob Baker Lexus in El Cajon, where Saylor's personal car was being serviced, was equipped with all-weather floor mats designed for Lexus vehicles.  Similar mats installed in 2007 and 2008 models were recalled by Toyota due to complaints the mats could slide forward and force the accelerator into an open position if not properly installed, according to the paper's report.
It was a loaner, the dealer would have installed the mats, anyway I said 'probably'.

Yup, in the car I drive (an auto 2000 Holden Vectra) you can just knock the stick forward to put it into neutral.

At 120mph the last thing you want to do is use the handbrake, that would definitely tip the car over ... a simple push on the Start button would have stopped the engine before he reached that speed ...

The floor mats in both Toyota and Lexus are supposed to have fixation clips to prevent them from sliding forth and the dealer should have explained certain functions about the loaner like the start/stop button ...

From experience I know how hard it can be to try and tell a customer how a different car works, they usually "know how to drive" and don't need any further information, the customers often are in a hurry when leaving their car in our care to get to their own work ... so I understand that important information from the dealer to the customers could have slipped ...
