i don't think it's a human right. just because the UN applies it to a charter of democracy, doesn't make it an innate human right.

Just because you deserve a right doesn't mean you'll get it. Of course you're right,, Cybargs. However, that's why, it's up to the courts to ensure that the person who injured one person in prevented from harming many more people.

yeah, the courts will do a great job of protecting a person's rights... 18 months down the line when the paperwork is done and the case reaches court

"human rights" are really provisions secured by social contract - nature will do nothing to ensure each and every person is given their "rights".

That said personal safety in general terms is the first thing secured by every social contract. It's not as if this right cannot be violated, but that can be said for any right. You can't completely secure any right, but personal security is the very basic aim of the social contract.

I'm using the term to talk about anyone and everyone who talks about social contract. I think you can actually speak generally and correctly say personal safety in some form or another is fundamental to any social contract. I mean I usually don't talk in absolutes like that, but without personal safety everything crumbles. Now the point of personal safety in most social contracts is to extend that idea to the right to personal property and the security of that property, but this assumes personal security is a forgone conclusion.
