Surgeons, none of this would have ever happened if the cyclist didn't take the wrong road. Therefor it is the cyclist's fault. However, the pedestrian should have used the crosswalk and looked both ways. The cyclist made the mistake of taking the wrong road, the pedestrian is at fault for the collision.

No matter how much I explain, I can't quite get it down right, I hope you understand what I'm trying to say.

stop trying to mathmatically divide the blame between the two active participants. holy hell is it pedantic.

erm hello mr. genius-- a game is a definite experience, you play it, you form an opinion and make a judgement.

these hypothetical scenarios with the biker/pedestrian could stretch on to infinity and are grounded in absolutely NOTHING

you're the one using caps to express rage, mr turd burgler.

from an insurance perspective there is always someone who's 'more' at fault.

and I wasn't arguing, I just want to demonstrate how stupid cammy is.

from an insurance perspective? why would a jaywalker make proceedings against anyone? they're both in the wrong. mutual shit.

If the pedestrian didn't eat that extra bagel he would've been earlier and crossed the road at a different time, none of this would've happened. Therefore it's the fat pedestrians fault who should be dieting and not eating bagels at all hours of the day.

You should always look both ways, no matter what.

peds get the benefit of the doubt.  If you are in a car and hit a guy jaywalking across a road you will most certainly be at some fault and be liable for damages.

plus the dude on the bike is a douche, i can tell from the 37 second video.

It doesn't cancel itself out, they were both in the wrong. The biker guy just was a big enough douche to criticise a guy he just knocked over though.

Lucky the pedestrian had built-in padding.

I do think it's funny we are debating who's at fault, but I'm enjoying it very much.

From an insurance point of view, if the pedestrian sued the cyclist for injuries who would be at fault?

I find it funny that some yokels think it's ok to bike along in the wrong direction on the street.

Chubby perhaps should've looked the other way too. I know I always look since you never know if someone is backing up a car or something. Doesn't hurt to turn your head unless your neck is broken. But then again on a one way street you should be able to count on that no one comes riding at you from the wrong direction. Both are at fault here in my opinion.

What angers me the most is how casual all this was to the cyclist asshole. Bet it wasn´t the first time for him knocking someone over while driving the wrong way.
Fucken hate those guys. Never understood what makes them think driving against traffic rules is okay just because you can do it "easily" on a bike.

For some reason two-wheeled drivers seem to think they can do what they want...

It's the same with motorcycles driving slalom on the highway and generally doing what they wan't in traffic...

I think motorcycles are awesome in traffic, you just pass through everybody. What's wrong with that?

Sometimes I just want to be driving a scrapper so I can open my door at motorcyclists driving between lanes...
It's illegal for a good reason...

What pisses me of the most though is people doing zigzags in the lanes between vehicles on the highway, they are a major danger to themselves and others...

It seems to be a world wide issue that cyclists think the rules of the road don't apply to them.  Every time I see one go through a red light I cross my fingers and hope they'll get smashed by a bin lorry.  It also fucks me off when a fully grown man in lycra comes screaming past me on the PAVEMENT.  Twats.

Dude, most of the reason people by motorbikes or peds or whatever is to get between traffic when its busy. Nobody likes to be sat around in traffic, and I sure as hell wouldn't if I could get between the cars.

The rules of traffic applies to everyone...

Driving a motorcycle is - on paper - the same as driving a car...

Just because you have half the wheels doesn't mean you have the right to enter traffic anarchy...

I have zero objections to mc's splitting on a highway that's standing still in the morning/afternoon traffic. If I see a bike splitting I always give more room. If the biker can get to his destination faster without murdering his clutch constantly, I'm happy to help. It's nothing away from me.

You americans are more accustomed to a gridlock I suppose, here in Europe highway traffic keeps moving and you obey the damn rules..

Having bikes running down middle of lanes is a recipe for disaster...

All the UK guys that are saying it was the peds fault at all. If this was in the UK only one of them would have been breaking the law, and that was the cyclist. It was 100% his fault.
