Right so here in the US people are required to have auto insurance (lots of people don't).  Some states have "no fault insurance" http://en.wikipedia.org/wiki/No-fault_insurance

WTF is this concept?  No fault?  You hit me motherfucker it is your fault.  What kind of lesson does this teach people?

also restricted in the right to seek recovery through the civil-justice system for losses caused by other parties.
I'm just gonna talk out of my ass here but I think the point is that if you get in a fender bender, your own company reimburses you and you can't sue the guy for $20 million dollars because of "emotional damages" or whatever other bullshit people pull in civil court.

doubt that.  its also way more expensive for no fault insurance.

You mean no-fault is more expensive? I think that's because it's like health insurance. You pay them money, and if something happens then they'll cover you. Whereas with, err, yes-fault insurance they get the other company to pay.

if something happens in a "fault" state you either get paid by their insurance or yours if you have uninsured motorist coverage.

Right. Where as in a no-fault state you get paid by your insurer.

What are we debating again?

Generally speaking, no fault insurance is most commonly applied to states where local factors make it problematic for insurance to operate in a normal way.  Florida is the most significant example, since they have so many elderly drivers.  It looks like they revised their no fault policies a year after eliminating the old ones.

Florida coincidentally has a state fund for property insurance due to the frequency of things like hurricanes in the area.

No idea.
This is supposed to keep premiums down because there's less paperwork to file.

South Carolina used to not require insurance, but now they do.  To my knowledge, every state requires it now.

this isn't the congo

I think in some states you can essentially fund your own insurance coverage. Like, you put it in a special account. Dunno why you would unless you're filthy rich.

Insurance is all pretty much a scam anyway. I don't know what No fault insurance is, in New York/New Jersey they have a it's your fault if the front of the car is hitting the other car. Even if it's the other drivers fault, as in someone cutting you off.

Except New Hampshire.

Many countries have this, I think its also called 50:50, no contest or whatever, its especially used for minor accidents.
In France it used to be the case that if people involved in an accident agreed it was not worth the trouble to get into a dispute and go 50:50 they would pay a lower excess.

If it removes the lawyers from the equation then it means the cost of insurance should go down a lot for everyone, and claims get dealt with quicker.

If it removes the people who go out looking for accidents so they can claim on other peoples insurance that would be good for everyone too.
If it comes out of their own insurance they'll pay for it themselves in the end.

How is it so big in other countries if paying for someone else's fuck-ups is such an American thing?
