We have the same laws here. You MUST take your break within the allotted time frame or get paid overtime. Obviously an employer doesn't want to pay overtime not just for cost reasons but also if it were to happen semi-regularly an employee could make a complain that they're being worked too hard. To avoid that the employer tells its employees they must take a break by the five hour mark no matter what unless told otherwise, which happens in exceptional circumstances. This is how it was at my old job in hospo at an international hotel. My current job is quite a bit different as it's much more autonomous and I can take a break whenever I want, providing I get the work done.mtb0minime wrote:
