the appeal has since been thrown out by the court.

No.  If people want an opt-in system of arbitration for civil matters, they are more than free to do so (as far as I know).  Criminal cases have no place being settled in those courts.  That's not implying that any criminal cases are, but I am just clarifying the point made by TheEternalPessimist.
