I am not a fan of liberal gun laws, but that's ridiculous. That gun clearly malfunctioned. I can't believe the poor guy was even charged with anything in the first place.
More importantly, if the ATF didn't find the rifle to be full-auto, and didn't find any parts in the rifle that would indicate that the weapon had been illegally altered, why uphold the verdict ?
Any good lawyer will have a field day in an appeal.

That depends on the wording of the law.
If guns are legal so you can defend yourself, why to you need anything beyond semi-auto.

There are many scenarios where full-auto may be desirable. If one believes that those weapons belong in the hands of civilians in the first place, that is.

Since the passage of the National Firearms Act of 1934 (when automatic firearms, short barreled rifles, "sawed off" shotguns, etc were restricted) there have been TWO crimes commited with legally owned automatic firearms in the US...one of which was when a police officer murdered his wife.
