French TV presenter 'owns Vista'

A French television presenter has sued Microsoft for "violation of intellectual property". Philippe Gildas accused the software publisher of illegally using the trademark "Vista".

Gildas registered the Vista in October 2003. This was two years before Microsoft registered its Windows Vista trademark with the INPI (French National Institute for Intellectual Property).

I find this trolling hilarious. I'm sure its a tactic that you wait to sue once who are suing actually starts making money.

Wow, you do not sue Microsoft. This guy is going to get raped by Microsoft's legal team. I wouldn't be surprised if Microsoft is suing Frenchy by the time it's all over

Remember it'll be tried in a French court. Microsoft don't have a very good legal track record in Europe.

They've been fined loads and loads of money (billions) before for silly little things. Like including Windows Media Player as part of the OS, the same thing happened with IE. The fines for Media Player are ongoing, at an ever increasing rate. MS pay fines of 3 million Euros a day to the EU, this is up from an initial rate of 2 million Euros a day and will continue until MS stop providing media player with OS's. They have released an edition without media player (XP edition N), but that hasn't been bought by anyone, so has cost them even more money.

I don't think this case will come to much, but it might. It's silly to rule it out.

...what? how can they be sued for adding something to their product?

Anti trust laws, monopolies, etc.

It's because it is unfair on software companies that specifically produce software for media playback. Few people buy third party solutions because they have no need to.

Chances are the fines will go up. This is a much bigger concern to MS than being sued over the name.
