Brian D. Kelly didn't think he was doing anything illegal when he used his videocamera to record a Carlisle police officer during a traffic stop. Making movies is one of his hobbies, he said, and the stop was just another interesting event to film.

Now he's worried about going to prison or being burdened with a criminal record.

Kelly, 18, of Carlisle, was arrested on a felony wiretapping charge, with a penalty of up to 7 years in state prison.

sounds like the police didnt like being recorded, but that is a little overboard.
it depends on how he is charged based on if there was malicious intent.....what malicious intent could there be?

Overboard. Police probably have something to hide if they don't want it to be seen/heard. If anything, it's merely more evidence for the person that's being charged.

The title of this thread is misleading.  You can't record audio, but you can record video.  At least that is what the article indicated.

so they arrest him with backup AFTER he gives him the camera willingly and also they take all the rest of his film thats unrelated? overkill much?

if he didnt know it was illegal, and complied when he was instructed to, why is this even an issue? was the cop doing something he wasn't supposed to be?

As a policeman in this day and age I wouldn't want to be filmed doing my job.  Some idiot would likely analyze it and find some reason to file a lawsuit.  Having family in law enforcement I completely understand where they're coming from.
