If the system works correctly, then the guilty people picked up on the battlefield will go to trial and the evidence will convict them and they will stay in custody and will never get a penny and why would they.
The Innocent ppl will be set free and as most of them have been abducted of the streets and held for years with no charge or evidence laid against them are well entitled to a payout. Its' against international law to lift anyone of the streets (see Italy) it could be argued as OK if there is irrefutable evidence against them and the citizens country agrees to it.
But when they have been Innocent ppl robbed of years of their lives while stuck in a hell hole thousands of miles from relatives and the law, then they deserve to be compensated.
Now ofcource some of you will say they shouldn't get a penny. And those ppl only expose themselves to be Islamaphobic, racist, bigots. Because they believe an Arab's life is worth less than a Westerners. And that a form of mob justice applies to Arabs and no one else.
