So a legal brief, submitted to federal court documenting the event, is not proof enough?  I got that whole background from the legal brief, and I linked to it.

They made class time available for the Gideons to come and give out bibles.  They don't set aside class time for any other organization to come and give out books or fliers.  The Gideons probably could have set up a table in a hallway somewhere or the lunch room, so that if students wanted the book, they could get it.

That act of setting aside class time is what sets this apart from other cases.
