He's 100% guilty, he gave a gruesome detailed description of what he did to this innocent girl. There's no "other side" to this story. He kidnaps a girl, assaults her, kills her, has sex with her corpse, and then mutilates the body.

People like this "man" shouldn't even get an appeals process. They don't even deserve a last meal or last rites. They deserve to be gone from this earth.

I agree 100% but the law is the law and all the "I's" have got to be dotted and all of the "T's" have got to be crossed before this guy gets his.

Everybody is entitled to appeal against a judicial decision. Lots of reasons why, but ultimately it's because if there is no route of appeal- then the law (which is ultimately governed by humans that make mistakes) is unalterable and lots of people would be locked up out of a mistake or for wrong reasons. Even people that are obviously guilty are entitled to an appeal- the law must apply to everyone equally. Even though I have no doubts that his appeal will be quashed instantly and he'll be sent packing to where he belongs... it's important that he gets chance to have his case reheard if he feels it necessary.

Also, don't forget that on appeal when a case is reviewed, the defendant isn't always completely 'let off' or reduced. Sometimes the appeal judge/jury may decide that the original sentence wasn't harsh enough- and will instead crank up the punishment. Don't assume that just because a rapist/murderer/sicko is getting an appeal, that s/he is getting an easy option out. He could find himself in far more trouble.

People do occasionally confess guilt when they are innocent, especially people who are mentally ill to some degree (as this guy clearly is), and that is why the whole process must be followed.  Of course, since he has been found guilty, lets get rid of this waste of air...

The only justification I can see for an appeal is, as others have pointed out, due process. And for the reasons given by spearhead, and for those reasons alone, due process should be followed.

I don't get the "lets get rid of this waste of air" attitude though - this guy, despite all the horrible things he has done, is a human being - he should never be allowed to do anything like this again, but, if he is mentally ill he should be given treatment for a condition that is not of his making.

If someone makes a cold blooded, but rational, decision to commit murder, now that's a different matter.

Theoretically, you are correct about the mentally unstable, but when they are unstable to this degree, I have no problem whatsoever with killing them.

You didn't. But based on previous posts, it was clear you were referring (primarily) to the abuse of overzealous prosecutors and such, rather than unethical defense attorneys.

I was merely pointing out that we have abuse of the system now by unethical actors, but that abuse on the prosecutorial side would be even worse.
