No sensible person would disagree with you, if you were defending yourself and it killed someone else it SHOULD be the other persons fault. Thats not necessarily the way the court would see it. The prosecution will do EVERYTHING it can to make you look like it was your fault. If the lawyer was good at his job, he could make you look like you provoked it ( or something , I dunno). Having said that YOU MUST DEFEND YOURSELF WHEN YOU ARE ATTACKED. If the worst happens deal with it later. I really hope you are never in that situation.

The criminal must know that that cop has the right to shoot if he sees a gun, in self defense. there are different interpretations of this rule, from country to country, but that's the basic idea.
There is, however, the rule of proportionality, as far as self defense is concerned, at least here in germany. The idea behind that is that you're only allowed to use the amount of force or those means in self defense that compare to the threat you are facing.
Example: if you face a drunk guy in a bar fight, shooting him with an automatic weapon in "self defense" would be excessive, unproportional violence. In that case, you'd likely face manslaughter charges. The argument would be that the drunk guy did not represent a threat to your life, and that killing him was therefore unjustified.
And yes, I believe that if you punch a guy to the death, you should be held accountable. Unless, of course, the death was the result of an accident ( the other guy tripping and falling, for example ), not a direct result of your own punches.
But if you deliberately punch someone, knowing that it could kill him, then you should face charges by all means.
I have always believed that people resort to violence too easily these days. The law as I understand it here is designed to make people think before they harm someone else physically. Not because self defense is frowned upon in general, but rather because the outcome of a violent confrontation is difficult to predict. And I don't want to be responsible for permanently disabling or even killing someone for bullshit reasons.
There are almost always alternatives to violence, that's how I see it.

To me, the outcome of a violent confrontation is too difficult to predict to engage in it so cautiouslessly.
The self defense laws here in germany are designed to make people think twice before harming someone else physically. At least I think that's the intention behind it. There are almost alyways ways out of these situaitons that do not involve violence.
