But what I ment was why the design stayed the same unlike the 4870's cooler which is totally different from the 3870' cooler

Perhaps the results the 3850 cooler was pulling off was sufficent enough for them.  No sense implimenting a new cooler for the sake of it.  I think the 4870 has a new cooler to improve its overhead for OC, especially now that the shaders are unlocked.
