and you get 3 meals a day with a roof.

http://www.cnn.com/2008/CRIME/06/25/sco … pstoryview

Kennedy was convicted of sexually assaulting his stepdaughter in her bed. The attack caused internal injuries and bleeding to the child, requiring extensive surgery, as well as severe emotional trauma, Louisiana prosecutors said...

... Justice Samuel Alito wrote the dissent, saying, "The harm that is caused to the victims and to society at large by the worst child rapist is grave." He was supported by Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas.

In his dissent, Alito wrote that the majority ruled against the death penalty "no matter how young the child, no matter how many times the child is raped, no matter how many children the perpetrator rapes, no matter how sadistic the crime, no matter how much physical or psychological trauma is inflicted and no matter how heinous the perpetrator's criminal record may be."
This part is just laughable:

Death penalty opponents contend, among other things, that it could give attackers a reason to murder their victims. In Wednesday's ruling, Anthony Kennedy agreed, writing, "A state that punishes child rape by death may remove a strong incentive for the rapist not to kill the victim."
Yeah, except then they'd also get the death penalty for not only raping a child but also killing it. Probably get on the 'express lane.'

It's interesting that they used the evolving standards of decency argument for their case, as it is easily argued that the crime above is one of the more heinous ones. Although only a year after Gregg v. Georgia, the court ruled to forbid the death penalty for rape of an adult woman in Coker v. Georgia.

Exactly! In Spanish prisons they cut your balls off the minute they find out you've committed a sex crime apparently.

Except that it'd be harder to catch the person without a witness.

If you start allowing the death penalty for crimes other than murder, where do you stop?

I think that the death penalty in itself is wrong. I'd rather see a criminal suffer the remaining years of their life in prison. 3 meals a day, so what? They'll never see the open sky again - I'll be happy.

And as others have said, child rapists always get the worst treatment in prisons.

Let them suffer. Death is too good for them.

Aside of the obviously high level of emotion in this decision, I endorse it.   I don't support the death penalty, but if I did, it would make sense to take life for life taken.  Rape/molestation/child sex trafficking, etc all destroy the life of the victims, true.  But taking of life for it is not logical.  If I were Jew or Muslim, then I'd probably support the death penalty..but I'd still not endorse killing perps of child rape...taking nothing away from their heinous crime.  I also don't support the isolation such child predators get in prison..I am all for general population with a big friggen sign on them and crotchless/assless chaps while their head is stuck in a vice.  Pump that bitch full of aids and hepatitis C..but don't kill him.

the death penalty for child rape is laughable at best. you know what else constitutes child rape? statutory rape. just wait, some state in the south would convict some poor chump for banging his girlfriend and kill him.

The US Code specifies what constitutes child rape

http://www.law.cornell.edu/uscode/html/ … notes.html

(b) Rape of a Child.—Any person subject to this chapter who—
(1) engages in a sexual act with a child who has not attained the age of 12 years; or
(2) engages in a sexual act under the circumstances described in subsection (a) with a child who has attained the age of 12 years;
is guilty of rape of a child and shall be punished as a court-martial may direct.
Oh, and someone explain to me how "hard labor" or "letting them get raped in prison" is any less cruel and unusual than killing them?

I think spending a lifetime in prison is worse than being executed.

take a look at part two there. it says a child who has reached 12 years of age so as described in subsection a.

Of course the best covenant would be to abolish the death penalty altogether.  That, or let the victimized person/people decide the punishment.

Yes, and while I don't think people should be so vengeful (because killing or torturing someone doesn't bring back your dead loved one), there should be a list of things the victimized should be able to choose.  I say full castration (all genitalia) should be on the list for qualifying baddies.

The argument is closure. While it will not bring the family member back the alternative is spending the rest of your days knowing that the convicted will be taken care of the rest of their life. That is why the victims family gets an invite to the execution. I'm on the fence here, but to hear about the cases of repeat offenders is unacceptable. It's failure in the worst way.

I know.  But I also realize that "closure" in the form of killing someone, still does not effect any change in conditions.  Sometimes, we get to see the vicitimized with an elevated sense of humanity and control saying "no, I don't want him to die.  living in hell is enough for me."  And then there's the "real" christians who let God do the dealing when the time comes...which puts to shame any device we can conjure.

I do believe our "justice" system..or rather "corrections" system is a joke, and is the real problem with things.  We have the right ideas...castration, jail, etc...but the corrections system is what's lacking reality.  3 square a day, 23 hours confinement with many luxuries and comforts while "PC" is NOT corrections or punishment.  Hard labor, "Lord of the Flies" (or "Prison Break's 'SONA'") is how prison should be with as few protections as possible for the more hardened criminals.
