California judge rules early cell phone termination fees illegal

The preliminary, tentative judgment orders Sprint Nextel to pay customers $18.2 million in reimbursements and, more importantly, orders Sprint to stop trying to collect another $54.7 million from California customers (some 2 million customers total) who have canceled their contracts but refused or failed to pay the termination fee.

Exactly!
They signed and agreed to do business with Sprint, clearly reading that there's an early termination fee.

Where does the government think they can get off controlling the pricing and deals a company can offer?

Fuckin Commiefornia.

or force people to actually read contracts.  not just sign because they got the latest phone to show their myspace friends.

Well see that's the problem, you each want something outside the contract. He wants more cash, you want expedited delivery. The intangibles are at work here, whereas in the OP 75% of people are apparently deadbeats.

not really a expedited delivery bc we have a rough estimate of time on a turn-key job but now we've been back and fourth for almost a month, so now I'm a month behind

but I assume the timetable is not in the contract. You're asking for a delivery time not in the contract, he's asking for compensation not in the contract.

Not to say he isn't being an asshole, only that in the strictly legal sense it makes sense. This ruling on the other hand doesn't make any sense.

a exact timetable can't be in a contract but for everything you do in the world you always get a timetable : delivery 2-3 weeks, 30 mins or less etc etc
a contractor can't stay in business if he tells you 3 months and now its in 41/2 months

sure it can, timetables go in contracts all the time. Maybe you could have put 4 months in the contract, with the understanding from him that it should be 3 months.

In any case I'm not saying you did anything wrong, just how this circumstance is different.

and clearly he can stay in business

he can try to stay in business but bad word travels faster then good word ....... we sign a contractor for x amount and have his word on 3 months at the end of the 3 months he is re-neging the contract and sets everything back by a month

and exact timetables are almost impossible to put in contracts .... ie : lumber yard runs low or out, you hit a naturely spring and flood the site, the rain etc etc

He did, however they ruled later that imaginations were fake, which is why they were able to nuke it.  That nullified the contract and Kyle no longer had to suckle his balls for 30 seconds.  But, later Kyle admitted that leprechauns were indeed real as they shaped the minds of the people, but refused to suckle Cartman's balls then, clearly breaking the contract, just as Caleeforneya is doing.

"has ruled that the practice of charging consumers a fee for ending their cell phone contract early is illegal and violates state law."

So, if you sign a contract to follow every order and to give up all personal possessions and freedom, you are bound by this contract even though slavery is illegal?

Pity they do not elaborate the reasons for the verdict, that is what always is missing in news articles, I hate it...

it doesn't violate state law in any way, if you provide someone a service, and they pay you for it, you can charge them in any way you want, and if it is in a signed contract they have to follow it
