Well generally people with the XXY chromosomes have generally male bodies, just with larger hips, less muscle and sometimes even breasts but still have the male genitalia then they would be counted as males.

Those with XYY would again count as males as they have the bodies of males but are just a bit bigger due to the increased male hormones that are produces as a result of the extra Y chromosome.

The use of XY or XX to determine the legal sex of a person would work if you just said that anyone with a Y chromosome is male, anyone without a Y chromosome is female.

What does Down Syndrome have to do with the gender of a person, since it relates to an extra copy of the material on the 21st chromosome (either as a complete copy or a partial copy usually attached to chromosome 14)?

Although women are often less fertile, and the men nearly uniformly sterile, that doesn't change the fact that they still have the required gear to make them "male" or "female".
