I'm pretty sure the Small Yacht had the right of way.. So even though it got owned, it was the big yachts fault for not correcting its course.

Starboard boat has the right of way (the big boat was in the right). It is international law-the boat on starboard (the other boat is on said boat's right side) has the right of way in any case. The vessel in which the video has been shot from may of been flying a government issued flag which gives them the right of way. No matter what, the larger boat from which the video was shot was in the right.
