Probably was drunk, doesn't help that he was dressed as a Nazi and was using a K98. Not that the cops probably even saw that, and especially if they're going to the scene knowing that people are complaining about gunshots, they're going to be on the edge before they even get there, and then if someone points something at them as they get there, game over.
