I search the TOS but couldn't find one that specifically stated that incorrectly listed items can be cancelled without notification and deemed a non-sale, etc but that sort of thing is usually a standard clause.

I'm pretty sure they will realize their mistake.

They have the right to revoke any order for any reason at any time I believe (They must refund though)


But hey if your the first maybe they will take the order and process it anyway

Once its in that box and in the tuck with a label on it with your address, its yours..

haha not a chance you are getting it at that price. Something like getting a 323€ gfx card for 232€ has been success when only one guy did the order...  but in extreme case like this its 100% no go.

In Australia you have to sell items at the advertised price. If they claim to be out of stock they have to prove they had reasonable supply of stock to cover the expected orders or give a raincheck at the advertised price. Wrongly advertised or marked price is no excuse and the business must bare sole and total responsibility for their mistake.

A few weeks ago I was in a bottle shop which had a case of beer for $60 and special 2 cases for $90, but they had forgotten to change the price but had '2 for' once I pointed it out they had to sell me both cases for $60 and then promptly fixed their error.

Yes but e-commerce is different from brick-and-mortar.  We have similar laws regarding respecting the listed price, but those seemingly don't apply to e-commerce sales.

The laws apply to all businesses operating within Australia. I don't know the specific laws concerning advertising in the US, but if they at all like ours then it shouldn't matter if it's e-commerce or retail shops.
