Interesting bit here that reinforces Dilbert's first point:

The National Highway Transporatation Safety Administraton recall report from 2007 found some Lexus drivers with stuck accelerators tried to turn off the car with the engine control button but didn't know the button must be held for three seconds.
Also interesting that San Diego 6 doesn't appear to have spellcheck.

Probably good for the other people in the road that the driver was a police officer trained for high-speed driving.

Yeah, my mom's BMW lets you put the car into neutral if you press on the shifter release. No need to use a manual override.

And remind me not to ever drive a Lexus. It's a bit strange considering they're always touting their latest innovations in safety and technology..

It was issued a statement from Lexus USA about this accident, it was used the wrong kind of floor mats in the loaner that caused the fatal accident that claimed the lives of 4 people.

If you turn of the ignition the steering usually locks.

Could have dropped it into first and hit the throttle, released the clutch and blown the engine if it had been stick shift.

the floor mats in my MR2 do the same thing  after while they slide down and the pedal gets wedged.  even the first time it happend i realized right away what it was. I just pushed in the clutch since it's manual and pulled the floor mat out.  but even if it was an automatic im pretty sure I would have been able to correct the problem quickly.

I could be wrong about this particular modle but he should have been able to bump it up to neutral even if he had to push the button in. sometimes when panic sets in all reasonable thought goes out the window so it's hard to really judge without being there.  turning the car off would have been possibly as fatal, as the steering would have locked and the power assist on the breaks would not be functional.

dropping it into first at that speed would send you sideways and flip the car.  and if it was manual just pushing in the clutch would suffice. there would be no need to let the clutch out at that pont

1) Read the article. It says witnesses saw fire coming from the wheels before the crash, which indicated heavy braking. In other words, the brakes were working but as long as the accelerator was pushed down apparently it wasn't enough to stop the car.

2) This is why I'll never drive automatic transmission. I've had my floor mat interfere with my pedals before, but my manual transmission saved my ass.

Cases like this are hard and arduous to proceed with. A case like this will last many years before anything happens. The most likely thing that will happen is the car manufacturer will drag the case through court until the person cannot afford to continue the proceedings, then the manufacturer will offer them a settlement and end the case. Then it's up to the federal government or legal ombudsman to determine whether or not to recall that model of car back to the manufacturer.
