Third party possibly? Either way, you don't leave any gun within reach of a child. You don't leave a magazine loaded gun just lying about. You don't chamber a round unless you are going to fire the weapon. Real gun on top, Wii one on bottom (Its a 3rd party one, the official Wii one is shiny white plastic).
If I was 3 I wouldnt know the difference. I'd say the manufacturer is partly responsible for making a children's toy that is so similar to the real thing.

And yes, when it comes to children's toys, gun replica's should not be allowed. Whats wrong with having the default Wii gun? If they had used that this wouldnt have happened.
