Maybe depends on who has more points then?

It's not who has more points.
Before I hit 1st Sergeant, another gunnery sergeant and I applied for commander.  I had more points (by several thousand), he got the job; we both applied at the same time.

Well that's a good bit of evidence, that might provide us with enough info to work out the deciding factors.

What are your scores like comparitively, e.g. do you have more command time than he?

Well that's wrong because I've gotten the acknowledgement a few times, hit Page Up and then had the "A player with a higher rank..." thing.

One time on a clan's server there was about a two-second pause after hitting the button before I was outranked, which made me very suspicious at the time that something funny was being done in the background to give a clan member command, although I don't think that's possible from what I've read subsequently.
