Should this be the ideal that dictates the every-day working of Western society? All public works, laws, law enforcement is all centered around trying to be as idiot-proof as possible, and giving slack for, if not rewarding those who either prove to be stupid enough or pretend to be stupid enough to make even the most idiot-proof systems fail.
For example the Miranda Warning only came into effect after some idiot raped a woman, confessed to the crime, but later got out of punishment because he claimed to not have known his rights at the time of confession. Even when we have a jury of our peers, justice is still hampered by inane laws and regulations that stop common sense.
Now some of this bureaucracy may be necessary to keep vigilante justice and corrupt officials from completely taking over the justice system, but it seems like the complications of legal proceedings are only making the loopholes bigger and bigger for many obviously guilty criminals to get out of punishment.
When do we tell the lawyers to shut the hell up and use some common sense? Should a limit be set on how much sense people must have to operate normally in our society and everyone without that much sense can get lost in the shuffle, or do we continue to pander to the most intelligent forsaken being in the country?
