Well, it comes down to what the concept of theft really is. Traditionally, theft has always been taking something from someone else without permission. If I went to the store and stole a copy of the game, that'd be theft, 'cause the store lost a $50 CD/DVD. In fact, there was nothing lost anywhere. At all. The downloader got a game at no loss to anyone else, and the developer likely got another person playing online, helping keep the game alive, and a new potential customer for sequels.
Should "theft" without any loss in any way really be a crime?

Oh and i agree with you fully, its a lot different than stealing a dvd from a store. because the manufacturer had to spend money on the disk and the case and all that, but on a computer, when you can simple 'copy' and 'paste' and all of the sudden you have 2 of something, it is not robbing anyone of there effort, and its not all that bad.
