U.S. District Judge James Selna issued the ruling Friday after a 16-month legal battle between student Chad Farnan and his former teacher, James Corbett.

Farnan sued in U.S. District Court in 2007, alleging that Corbett violated the establishment clause of the First Amendment by making repeated comments in class that were hostile to Christian beliefs.

The lawsuit cited more than 20 statements made by Corbett during one day of class, all of which were recorded by Farnan, to support allegations of a broader teaching method that "favors irreligion over religion" and made Christian students feel uncomfortable.

During the course of the litigation, the judge found that most of the statements cited in the court papers did not violate the First Amendment because they did not refer directly to religion or were appropriate in the context of the classroom lecture.

Instead, he plans to ask the court to prohibit Corbett from making similar comments in the future. Farnan's family would also like to see the school district offer teacher training and monitor Corbett's classroom for future violations, Monk said.

What a little cunt. I had plenty of teachers in high school and now in college that were either really religious things or nonreligious and I've had teachers say things that could be considered insulting to either a race, nationality, or religion and nobody ever complained or brought a lawsuit. Kid didn't really win anything but just lost it a bit more for Christians.

I agree, with the OP too. People from both sides of everything say shit all the time. It goes to show you how much of a joke it was, considering the ruling effectively did nothing; and was probably only covered by maybe a local paper besides Fox news.

You beat me to it posting this.

I am not saying that the school should teach either way, but I do think that the teacher should at least not beat down others' beliefs. The kid had a valid point about the 1st Amendment. The teacher bashed his beliefs, and should not have done that.

I might think it was an issue if he had sued for money, but as he did not, it is a non-issue. No big deal IMHO.

What the public school teacher did violated the constitution. It does not matter if you agree with his personal beliefs or not.
"when you put on your Jesus glasses, you can't see the truth."
"When you pray for divine intervention, you're hoping that the spaghetti monster will help you get what you want."
Corbett referred to creationism as "religious, superstitious nonsense,
I would also say it was a violation if it were religious nutjobs telling their students to go home and prepare for the return on the antichrist (if they were public tax paid teachers).

First amendment also states you have a right to free speech. I stopped caring about the religion period so I don't care either way but my point still stands, kid was being a real cunt.

You do not have the right to free speech when pushing religious views while working for the state. Period. This goes either way.. An obvious point you aren't getting.

Shitting on another persons personal belief system would make you a cunt also.

Can we impeach all the members of congress along with the president then? They all speak of their religion and their religious views while in office I guess just talking about your views is considered pushing now?

You do not understand separation of church and state at all. He has the right to say whatever the fuck he wants outside of the classroom. But he can't attack anyones religous views while being paid by the taxpayer.

Last time a teacher from the school was in a court room:

Spradlin has said, however, that Corbett made the remark about creationism during a classroom discussion about a 1993 case in which a former Capistrano Valley High science teacher sued the school district because it required instruction in evolution.
Was that a separation of church and state issue as well?

You can argue that evolution shouldn't be taught in classrooms at all if you want to go down the path of State vs Church seperation.

Just talking? ..lol did you even read what he said? If a politician was going around calling anyones religion nonsense then yes. He should be removed from office. I'm consistent in my beliefs.. even if reality isn't.

There is also a bit of a difference between a politician who is often asked where they stand, and an educator of children, whose job it is to mold minds.

Neither of ours are and they aren't compatible which each others either.

A history teacher is not meant to mold minds but present information and allow the student to make up their own mind on the matter. Seems like the child doesn't comprehend that.

Then it can be argued that any mention of religion in a government funded environment should be banned, how do you feel about a ban on the Pledge of Allegiance due to the statement "under God" ?

I'm sure it attacks someones religious views as either an atheist, or polytheist.

Yes reap I want to go down the path. Are you conceding that you don't understand the separation now? Or are you just quoting free speech while ignoring the other parts of our constitution? Pretty damn selective in your reasoning aren't you?

Creationism is religious, it is a product of superstition, and it is nonsense. The is no evidence supporting the creationist theory, at all.

If teachers can be charged with telling the truth, your educational system has severe problems.

Never heard of the Flying Spaghetti Monster? He shouldn't have sued. I didn't agree with a lot of what my teachers said and I didn't complain or sue I Turned the other cheek. It was extremely petty of the student and his parents. He should have just silently disagreed and took refuge in the fact that he was right in his mind.
